01Scope
These terms govern use of Bildena, provided by Bildena GmbH i. Gr.. The service is offered to schools, school authorities and comparable organisations, not to consumers. Conflicting terms of the customer do not apply unless agreed in writing.
02The service
The product is a web application for building and managing school timetables, including a constraint-solving engine and an assistant. The functional scope is described on the product page. Reasonable further development, including changes to individual features, remains reserved.
03Accounts and obligations
Keep access credentials confidential and use separate accounts for staff. Enter only data you are entitled to process. Do not attempt to disrupt the service, circumvent usage limits, or resell access without a partner agreement.
04Fees and payment
Prices are stated in EUR, exclusive of VAT where applicable. Subscriptions renew for the selected term and can be cancelled to the end of that term from within the product. Price changes are announced at least three months in advance and never take effect mid-term.
05Your data
Your data remains yours. Export in open formats is available at any time. After termination, data is retained for 90 days so the account can be reactivated, then deleted; earlier deletion can be requested. Details are governed by the privacy policy and the Art. 28 agreement.
06Availability and support
We target 99.5% monthly availability, excluding announced maintenance windows, which are scheduled outside school hours. Support is provided by email in English, German and French.
07Warranty and liability
We are liable without limitation for intent, gross negligence, and injury to life, body or health. For slight negligence, liability is limited to breaches of essential contractual obligations and capped at the fees paid in the preceding twelve months. The service supports timetable decisions; reviewing and adopting a generated plan remains the school's responsibility.
08Governing law
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Place of jurisdiction is the registered seat of the company, where legally permissible. Should individual provisions be invalid, the remainder stays in force.
